Terms of Use
1. Terms of Use
Microburbs Pty Ltd provides real estate data access through its service. By using the platform, you agree to comply with these Terms of Use and all referenced policies. If you do not agree to these terms, you should not proceed.
2. Accessing the Service
Users must be at least 18 years old. We do not guarantee uninterrupted service availability and reserve the right to suspend or modify offerings without notice. Users are responsible for their computer system's technical requirements and internet connection security.
You may not use any automated program to access our service, including scraping technology, bots, spiders, or web crawlers. Reverse engineering, decompiling, or tampering with software or hardware is strictly prohibited.
3. Changes to Terms
We reserve the right to amend terms at any time. Changes become effective immediately upon posting. Invalid provisions do not void remaining terms.
4. Nature of Service
This Service provides you with access to real estate data. By subscribing to or using this Service, you are paying for access to the data and not any specific outcomes.
The data is supplemental and should not be the sole basis for property purchasing or financial decisions.
5. No Guarantees
Service use does not guarantee property purchases, rentals, or specific real estate outcomes. Data comes from various sources and while we make every effort to keep it current, we cannot guarantee the accuracy, reliability, or completeness of the data presented.
Some data may be outdated. We are not responsible for decisions based on outdated or inaccurate information. Our Service may contain bugs or experience downtime. We do not guarantee uninterrupted access.
6. Intellectual Property
Content is copyright-protected and unauthorised copying or use is prohibited.
7. Warranty
Content provides general information, not professional advice. Users should seek professional guidance before acting. While reasonable update efforts exist, we do not guarantee accuracy or completeness.
Users must verify data from authoritative sources before making decisions. By using the service, users warrant they have legal authorisation to share provided data without infringing third-party rights.
8. Limitation of Liability
In no event will Microburbs, its directors, employees, agents, or affiliates, be liable for any indirect, consequential, exemplary, incidental, or punitive damages. Users assume all service-related risks.
9. Prohibited Uses
Large-scale report downloading beyond individual suburb evaluation is prohibited. Building offline databases from the data is strictly forbidden.
10. Refunds Policy
All subscription fees and one-off purchases are non-refundable. By subscribing to or purchasing access to the Service, you acknowledge and accept that payments made to Microburbs are final. You are paying for access to data, not for any specific outcome, result, or guarantee. Your decision to purchase is made on the basis of publicly available information describing the Service, and you are expected to evaluate that information before paying.
Monthly and annual subscriptions may be cancelled at any time. Cancellation stops future billing but does not entitle you to a partial, pro-rata, or unused-period refund for the current billing cycle. No refunds are issued for unused subscription time, change of mind, changes in your circumstances, dissatisfaction with the data, variations in data recency or update frequency, downtime, bugs, or failure to use the Service.
Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law that cannot lawfully be excluded. Where those rights apply, our liability is limited, at our option, to re-supplying the Service or refunding the price paid for the specific Service found to have failed to meet a consumer guarantee. The service targets standard residential properties including single-family homes, standard residential blocks, typical suburban properties, and secondary housing stock — claims relating to atypical, commercial, or non-residential properties fall outside the stated scope of the Service.
Refund requests relying on Australian Consumer Law rights must be submitted in writing to [email protected] and must include account details, purchase date, a specific description of the alleged failure, and any supporting evidence. All claims are assessed on their merits and processing typically takes 5–10 business days. Initiating a chargeback or payment dispute without first contacting us and allowing a reasonable opportunity to respond may result in immediate suspension or termination of your account and recovery of associated fees.
